Rubbish Collection Hounslow Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Hounslow provides rubbish and waste collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any rubbish removal, waste collection, clearance, loading, transporting or related service provided by Rubbish Collection Hounslow.

Customer means the person, business or organisation that requests or books the Service.

Waste means any items, rubbish, junk, household waste, commercial waste or materials presented by the Customer for collection, removal or disposal under the Service, excluding prohibited materials.

Prohibited Waste means any items that we are not permitted to collect or dispose of under law or our licences, including but not limited to hazardous waste, clinical waste, asbestos, certain electrical items, chemicals, solvents, gas bottles, pressurised containers, and any other restricted or illegal materials.

Site means the property, premises, land or location at which the Service is to be performed.

Agreement means the contract between the Customer and Rubbish Collection Hounslow comprising these Terms and Conditions and the details of the booking confirmed to the Customer.

2. Scope of Service

Rubbish Collection Hounslow provides waste and rubbish collection services to domestic and commercial Customers. The specific scope of the Service, including the type and volume of Waste to be collected, the time and date of collection, and applicable charges, will be agreed at the point of booking and confirmed to the Customer.

The Service may include loading Waste from the Site, transporting it for lawful disposal or recycling, and issuing a waste transfer note where required. We reserve the right to use third parties or subcontractors to perform all or part of the Service, while remaining responsible for the overall performance of the Agreement.

3. Booking Process

The Customer may request a Service by telephone, email or through any other booking method we make available. At the time of booking, the Customer must provide accurate and complete information, including:

1. The address of the Site and any access restrictions.

2. A description of the Waste, including type, approximate volume or weight and any special characteristics.

3. The preferred date and time for collection.

4. Contact details for someone authorised to be present at the Site.

We may provide an estimated quote based on the information provided. All bookings are subject to our confirmation. We reserve the right to amend or withdraw a quote if the information given by the Customer is incomplete, inaccurate or misleading.

The Agreement is formed when we confirm the booking to the Customer, either verbally or in writing, and the Customer accepts any quoted charges and key terms.

4. Service Area and Access

Our primary service area includes Hounslow and surrounding locations. We may agree to provide services outside this area at our discretion, and additional charges may apply.

The Customer must ensure that safe, suitable and reasonable access is available to the Site at the agreed time. This includes arranging any required parking, permits, gate codes, building access or lift usage. If we are unable to gain access, or if access is unsafe in our reasonable opinion, we may cancel or rearrange the visit and may charge a call-out or wasted journey fee.

5. Customer Responsibilities

The Customer is responsible for:

1. Ensuring that the person making the booking is authorised to enter into the Agreement.

2. Ensuring that all Waste to be collected is clearly identified and separated where required.

3. Declaring any items that may be heavy, bulky, fragile or difficult to move.

4. Ensuring that the Waste does not include any Prohibited Waste.

5. Providing a safe working environment for our staff or contractors at the Site.

Where Waste is to be collected from inside a building or from private land, the Customer warrants that they have the authority to grant us access and to permit the removal of the Waste.

6. Prohibited Waste and Misdescribed Items

We are not permitted to collect or dispose of Prohibited Waste. If the Customer presents any such items, we may refuse to collect them and may cancel or modify the Service. If we discover Prohibited Waste among the items after loading has started, we may unload the affected items, amend the price, or terminate the Service.

If Waste has been misdescribed or materially differs in volume, type or difficulty from that indicated at booking, we may adjust the price, refuse the additional items or propose an alternative arrangement. If the Customer does not accept any revised charge, we may cancel the Service and charge for any time or costs already incurred.

7. Pricing and Quotations

Prices for the Service are normally based on factors such as volume of Waste, weight, type of material, labour time, access conditions, and disposal or recycling charges. Any quote provided in advance is an estimate only and may be adjusted on site once we have inspected the Waste.

We will inform the Customer of any change to the price before proceeding. If the Customer does not agree to the revised price, we are not obliged to carry out the Service and may charge a reasonable call-out, assessment or cancellation fee to cover time and travel.

All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes where required by law.

8. Payments and Invoicing

Unless otherwise agreed, payment is due on completion of the Service at the Site. We may require payment in advance for certain bookings, larger clearances or commercial accounts.

Accepted payment methods may include cash, debit or credit card, bank transfer or other methods we notify to the Customer. For commercial Customers, we may agree credit terms at our discretion, in which case payment is due within the period specified on the invoice.

If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate, and to recover any reasonable costs incurred in pursuing late payment, including legal and collection fees.

9. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting us as soon as possible. Where the Customer cancels more than 24 hours before the scheduled Service time, no cancellation fee will normally apply, unless specific non-refundable costs have already been incurred.

For cancellations made less than 24 hours before the scheduled Service, we may charge a late cancellation fee or a percentage of the agreed price to cover allocated labour, vehicle and administrative costs. If our team arrives at the Site and is unable to carry out the Service due to Customer default, we may charge a wasted journey or full service fee.

We may cancel or reschedule a booking if affected by unforeseen circumstances, including but not limited to vehicle breakdown, severe weather, staff illness, safety concerns, or legal or regulatory reasons. In such cases, we will aim to notify the Customer as soon as reasonably possible and offer a new appointment. We will not be liable for any indirect or consequential loss arising from such cancellation.

10. Performance of the Service

We will use reasonable care and skill in providing the Service and will seek to carry out collections at the time and date agreed. Any times given for arrival or completion are estimates only and are not guaranteed, though we will use reasonable efforts to keep the Customer informed of significant delays.

We will take reasonable steps to avoid unnecessary damage to property while carrying out the Service. The Customer acknowledges that some risk of minor scuffs, marks or wear to surfaces may be unavoidable when moving heavy or bulky items, particularly where access is restricted.

11. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Agreement, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the relevant Service.

We shall not be liable for:

1. Any loss of profits, business, revenue, opportunity or goodwill.

2. Any indirect or consequential losses or damages.

3. Any loss arising from the Customer providing incomplete, inaccurate or misleading information.

4. Damage to items that were already defective, damaged or in poor condition.

The Customer is responsible for removing or securing any valuables, fragile items or items of special value before the Service is carried out. We will not be liable for loss of or damage to items that the Customer has failed to remove or protect, where such loss could reasonably have been avoided by the Customer.

12. Waste Handling and Regulations

Rubbish Collection Hounslow will handle, transport and dispose of Waste in accordance with applicable UK laws and regulations relating to waste management, including duty of care, licensing and transfer documentation requirements.

Where legally required, we will provide a waste transfer note or equivalent documentation recording the transfer of Waste from the Customer to us or to an authorised waste carrier or disposal facility. The Customer agrees to retain any such documentation in accordance with applicable regulations.

The Customer confirms that they are the owner of the Waste or are otherwise authorised to arrange its collection and disposal. Once Waste has been loaded onto our vehicle and the Service is completed, ownership of the Waste passes to us, subject to any applicable legislation.

13. Environmental Commitment

We aim to dispose of or recycle Waste in an environmentally responsible manner, using licensed waste transfer stations, recycling facilities and disposal sites. While we will take reasonable steps to maximise recycling and recovery, we do not guarantee that any particular item will be recycled, reused or recovered.

14. Complaints

If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as possible, providing full details of the issue. We will investigate the complaint and aim to respond within a reasonable timeframe. The Customer must allow us the opportunity to inspect any alleged damage or problem before remedial action is taken by any third party.

15. Force Majeure

We shall not be in breach of the Agreement or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, extreme weather, traffic disruption, accidents, strikes, lockouts, acts of government, public health emergencies or failures of utilities.

16. Data Protection and Privacy

We will collect and process personal data about the Customer as necessary to provide the Service, administer bookings, process payments and comply with legal obligations. We will handle such data in accordance with applicable data protection laws in the United Kingdom.

17. Variation of Terms

We may amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that Service. Updated terms may be made available on request or via our usual communication channels.

18. Assignment

The Customer may not assign or transfer their rights or obligations under the Agreement without our prior written consent. We may assign or subcontract our rights and obligations, in whole or in part, provided this does not materially reduce the level of Service to the Customer.

19. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

20. Entire Agreement

The Agreement constitutes the entire understanding between the parties and supersedes any prior discussions, correspondence or representations relating to the subject matter. The Customer acknowledges that they have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.

21. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service provided by Rubbish Collection Hounslow.
